The Failure of the 28-Article Peace Proposal for Ukraine: Why Peace Negotiations Continue to Stumble

Europe felt a moment of respite on Monday, as the tension sparked by the presentation of a new 28-article proposal for resolving the conflict appeared – temporarily – to have been defused. A Washington representative spoke of "significant advancement" after bilateral negotiations in Geneva. On Monday night, Moscow made its countermove: another massive barrage of aerial bombardment on Kyiv.

The Pattern of Diplomacy and Destruction

The sequence of opposing developments captured the grim essence of the recent timeframe. By day, political struggles are fought: hopeful statements are delivered from multiple capitals. Considerable effort is devoted on containing certain initiatives. By night, Moscow forcefully demonstrates the world that, for them, war remains the main instrument for achieving "peace".

After-Dark Attacks

As the offensive developed into the early hours of Tuesday, the current condition of Ukraine's defenselessness was exposed. Ukraine is able to track missile launches from Russian territory, a capability afforded by up-to-date information. From witness perspectives, military aircraft that had been dispatched to intercept incoming aerial threats roared overhead – advanced fighter aircraft delivered to Ukraine by Western partners.

Soon thereafter, Kyiv's missile defense activated: several firings deployed against a incoming threat. This was a modern interception technology at work, presumably provided by partner states. Every firing jolts you unexpectedly, causing tremors. The moment of terror quickly transforms into sober acceptance: possibly the approaching threat won't hit its mark this time, sparing the city from catastrophe and additional electricity failures.

Continuous Dangers

Following this, a automatic firearm opened up on a drone close by, part of a rapid response unit – almost certainly Western-made equipment. Regrettably, the bullets missed the opposing UAV – it pressed on overhead toward its target.

Intermittently, this carried on until dawn. Kyiv faced the daybreak reports: multiple fatalities, devastation and utility failures in multiple buildings as a result of the nocturnal offensive. As customarily, everyone still continued their routines – living the war. But those 24 hours encapsulated Ukraine's vital need on international aid – a reliance that neighboring countries are clearly incapable to fill in the short term.

Failed Diplomacy

The detailed framework from US administration sparked intense emotion, debate and profound anxiety – and temporarily diverted attention from Ukraine's largest corruption scandal in years. Yet, we have experienced comparable situations, after prior negotiation attempts and multilateral gatherings.

Every new approach from American administration follows the consistent cycle: a negotiation push against Ukraine, which Kyiv, with other European capitals, effectively counters. They contain the crisis but never actually win the battle. This trend will, certainly, persist.

Tactical Assessments

It is convenient to criticize particular leaders of repeatedly advocating Kremlin's demands. But that does not seem to be the complete picture. US administration works based on a principle well known to seasoned negotiators: you cannot secure via talks what you have been unable to protect through force. The White House assumes that it is unfeasible to force Russia to relinquish the land that it presently holds in Ukraine's occupied territories.

The problem is that while acknowledging this situation, Washington does little to deter Moscow, through diplomacy or military means, from believing that the current condition will not shift further in its advantage in the months ahead.

Conflicting Perspectives

Therefore, the Kremlin is confident that duration works to their advantage – that Ukraine and its partners are nearing depletion. Their reason to accept conditions that does not give them the greatest potential benefit is virtually nonexistent. There may be many attempts to achieve ceasefire, but they will continue as long as Russia's leader remains supremely confident in the outcome.

On the contrary, Ukrainian leadership believes that Ukraine can still persist, progressively conceding lives and land but averting a entire defensive failure until situations evolve in its advantage.

Present Conditions

Factually, there are no real preconditions for a ceasefire. Now, personal considerations are becoming relevant: political desires to broker a ceasefire and secure international recognition, and the government's twin challenges – on one hand, not to estrange crucial supporters, and on the other, to unite the population around the national cause against any initiative Kyiv finds unacceptable, so that their priority does not shift toward domestic problems. And although their task will now be much harder after latest incidents, it remains very improbable that this will alter their fundamental strategy.

These two forces are influencing discussions.

Conclusion and Outlook

It took a mere seven days to terminate the 28 points of the latest plan. Assertive and inconsistent approach of the matter by American leadership, pushback by Ukraine and the remaining European nations, along with calming attempts of negotiators, and finally, latest revelations, all achieved their purpose.

While new initiatives based on old ideas are imminent, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to counter political attacks from Washington that are rooted in Kremlin requirements and reflect specific hesitation to modify developments, if they maintain solidarity and improve their protective measures at a much faster pace. If they do, neither political nor armed coercion will be able to break them. In the meantime, Ukraine's capacity to counter nocturnal attacks will, for the coming months, primarily depend on ongoing international assistance.
