Federal Judge Orders Release of Abrego Garcia from Immigration Detention
A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement is without legal authority.
"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.
The situation stems from a erroneous deportation to El Salvador in March, which US authorities later acknowledged was an error. After his return to the United States to answer human smuggling charges, he was held in federal detention.
In her decision, the judge pointed out that the government does not have a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
Background of the Legal Challenge
The legal proceedings center on conflicting claims. While the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this claim.
He has also entered a not guilty plea to the smuggling counts, which are part of a ongoing criminal case in Tennessee.
Terms of Release
The court, who was overseeing his challenge to removal in a federal court, determined that he must now comply with the conditions of his bond from jail in Tennessee. This order shifts his supervision to the Tennessee court.
This decision represents a significant turn in a complex immigration battle featuring allegations of mistaken imprisonment and contested gang associations.
